International Arbitration

Emir Bağış is an attorney-at-law at Juris Attorney Partnership. He provides legal consultancy in the fields of arbitration, mergers and acquisitions, contracts, WTO law, and gives dispute resolution/prevention services. He provides dispute resolution services in institutional arbitration forums such as ICSID, LCIA, ICC, as well as ad hoc arbitration. He specializes in international investment arbitration, and WTO law.

> Projects Participated

  • He worked as a research assistant in "Identification of Damage in ICC Arbitration Orders" study, which was conducted by Queen Mary University of London (QMUL) by examining 200 different ICC awards.

  • He worked at the Ministry of Trade (former ministry of Economy) as a Lawyer Foreign Trade Specialist between 2012-2019 with a focus on investment law. He negotiated International Investment Agreements, Free Trade Agreements (STA), Investment and Service Trade sections of Economic Cooperation Agreements (ECA), carried out works in Foreign Direct Investments Legislation and Investment Incentive Legislation.

  • He took part in Bilateral Investment Treaty (BIT) negotiations with more than 20 countries as the legal expert of the negotiation team.

  • He took part in the negotiation and preparation processes of the Investment and Trade in Services Chapters under Turkey-Korea FTA which was first of its kind for Turkey. In this new generation International Investment Agreement, which includes Market Entry commitments and comprehensive obligations, He carried out coordination between the Ministry and other Public Institutions and Non-Governmental Organizations in the process of determining country specific commitments and took part in the preparation process as the legal expert of the team.

  • He took part in FTA and ECA Investment-Trade in Services Chapter negotiations with 6 countries.

  • He attended Joint Economic Commissions (JEC) and Joint Economic and Trade Committee (JETCO) meetings with more than 30 countries as the legal expert responsible for investment law, and took part in the negotiations of the Agreements and Memorandum of Understandings signed as a result of these meetings.

  • He attended meetings on investment law, of institutions such as United Nations Conference on Trade and Development (UNCTAD), World Bank (WB) – Doing Business, International Sustainable Development Institute (IISD), as the representative of Turkey.

  • He conducted work in 3 different countervailing duty investigations carried out against Turkey within the scope of the WTO Subsidies and countervailing Measures Agreement.

  • He carried out more than 20 on-site inspections with respect to Investment Incentive Certificates.

  • He provided legal consultancy to Turkish companies regarding BITs with respect to investment arbitration.

  • He took part in the preparation of the (draft) Law on the Establishment of the Investment Monitoring and Dispute Resolution Board.

  • He contributed to legislation work and activities carried out within the scope of OECD- Multinational Enterprises Guide and the National Focal Point (NCP) of the Guide.

  • He organized CEO meetings held at the Ministerial, Prime Ministerial and Presidential level and attended as a Ministry representative.
