CYBERSECURITY LAW



Since cyberattacks have become widespread and have devastating effects today, the issues of cybersecurity law and how states will establish sovereignty in cyberspace are of interest to all. In this article, we will discuss the meaning and importance of the concept of cybersecurity.


Cybersecurity indicates the entirety of technologies, operations, and exercises created to protect the security networks, technological devices, programs, and data that are created to protect the cyberspace from attack, damage, or unsanctioned access and to “assure the confidentiality, integrity, and accessibility” of the information processed in this cyberspace [1]. According to some authors, cybersecurity can also be expressed as information technology security. The concept of cyberspace, which is mentioned in the definition, generally covers communication, data distribution, and data processing over the internet and other networked technological devices [2]. Cyberspace is a borderless global platform consisting of technical components such as the internet, telecommunications, computer systems, and satellite communication services. Cyberspace is defined as the “common memory of all humanity” in terms of its constituent components. This feature makes it impossible to establish state sovereignty or property rights in cyberspace [3].


The primary purpose of cybersecurity is to protect the information system, and the information collected or processed on this system against a cybersecurity attack or cybersecurity exposure. Providing this protection through a law against cyberattacks is the purpose of cybersecurity law. A cyberattack constitutes aggressive activities against computers and similar networks or systems and activities that disrupt or completely destroy the critical cyber system, its assets, and functions. The damage done by the cyberattack is in three grades. Cyberattacks primarily target computer systems or networks, data, software, or systems. Therefore, a cyberattack directly harms cyberspace. Although the attack in the cyberspace directly affects the computer systems, the damage that occurs in the system affects the services in which the computer systems are used, and finally, individuals who benefit from this service[4].


Briefly, cyberattacks harm the cyberspace, services, and individuals. Cyberattacks can be committed individually or they can be committed by organized crime groups at the global level. Due to the transboundary nature of cybercrimes committed by organized crime groups, cybersecurity has become an important concern to the international community as well.


Cybersecurity law is a set of rules that will support the confidentiality, integrity, and usability of public and private information, systems, and networks by using forward-looking regulations and incentives to protect individual rights and privacy, economic interests, and national security.
